2. General terms and conditions
a). We reserve the right to a partial order completion for reasons beyond our control (e.g. missing product in the suppliers’ warehouses). In case of any problems with the order completion, we will inform the buyer about that fact within 3 days.
b). In the case when the buyer wants to receive 100% of the order, we suggest choosing the form of payment: bank transfer.
c). The User agrees to receive information from the webshop which are necessary to process the order for the e-mail address provided by him.

d). Users may make their accounts available to third persons at their own risk.
e). In case of any changes in personal details included in the registration form, the user shall be obliged to update them.
f). The user has the right to request the administrator to delete his personal data without delay, also known as the "right to be forgotten" by sending an e-mail to: firstname.lastname@example.org
g). If you wish to issue a VAT invoice, please check the box in the checkout: I would like to receive an invoice and complete the form correctly.
A VAT invoice may be issued up to 90 days from the date of purchase.
h). The shop applies the European Code of Procedure in Electronic Trade. The English version of the code is available under the following link: http://www.euro-label.com/pl/kodeks/index.html
i). There is no possibility of personal collection of the ordered goods.
j). Products placed on a special order, acc. to the annex 4 of Terms and Conditions, will be order from supplier/producer warehouse only after advance payment in amount of 60% of product/s value had been received.
Withdrawal from the distance contract does not apply to products ordered this way – acc. to the annex 4 of Terms and Conditions.
The customer will receive an individual confirmation of the exact sum of the advance payment once products availability in the supplier/producer warehouse has been confirmed. Please issue the payment only after receiving the individual confirmation.
k). Using the Service requires: Internet access; Microsoft Internet Explorer browser (version no older than 5.0) or Mozilla Firefox browser (version no older than 2.0). Services provided via e-mail require possessing active and correctly configured e-mail account.
l). It is forbidden for the Customer to deliver any illegal content.
m). The sales agreement is in English.
n). The products in the cart are stored by the system of the store for a period of 30 days. After this time the cart is automatically reset.
3. Possible ordering methods, changes in orders
a). Ordering through Fishing-Mart Internet shop (by created account or as a purchase without registration).
b). For orders placed via e-mail or via the webshop without registration, loyalty program points are not charged.
c). The minimum amount of ordered goods is 5 EUR (including Vat).
f). Changes in the order, ordering the goods to an existing order
Upon a retail customer’s request delivered via e-mail we may make changes in the existing order no later than on the 1 day after its being made - if the order has not already been packed or sent.
Such changes may concern:
- adding a new product
- resignation from the ordered product
The customer is always informed by e-mail about changes in the order. If you want to make changes please reply to the email you received within 24 hours of receiving it.
In this case, the changes may concern:
- acceptance of the changes (we do not require contact for this purpose)
- adding a new product (please enter the product index)
- resignation from the whole order
The possibility of changing the order does not apply to orders made with business entities, which are treated as final without the possibility of further modification.
Orders are processed in the order of receipt of the order and the date of its submission.
If to the pending order will be placed second order with a request to combine orders, in this case the combined orders will be processed by the date of receipt of the last one.
Products ordered separately after two days from the first order will be treated as a separate orders with an additional shipping fee.
g). Adding a product to the cart
Adding a product to the shopping cart does not mean the reservation of this product, it is only temporary storage until the order is processed.
If the price of the product changes, the price in the basket will change, the same will be when the product is removed from the offer than automatically removed from the cart.
4. The loyalty program, special offers
a). The loyalty program
Points are scored for the ordered goods and stored in a customer’s account (available upon logging on page https://www.fishing-mart.com.pl/en4/products/awards).
For the collected points you can choose free prizes, which can be found in the section: Loyalty program.
The prizes selected by the customer are always sent with the order for the fishing tackle.
The prizes are only realized if they are placed through the webshop system.
The prizes are not executed if they are sent by e-mail or entered in the order in the field: Order notes.
For orders for which a discount has been granted, or free products have been added, no points of the loyalty program are charged.
For orders placed by e-mail a loyalty program points are not charged.
b). Products with a special price
Products with a special price are not charged a loyalty program points.
Special price products valid while stocks last.
In products with a special price, we do not guarantee a quantity higher than one piece of the ordered item.
5. Methods of payment
a). Available forms of payment:
- bank transfer (after our individual confirmation) - in the case of non-payment within 7 working days from the date the order is automatically canceled.
- online payment via a credit card:
- Visa Electron
- MasterCard Electronic
Online payments are handled by eCard S.A.
b). When making purchases with the option of bank transfer, the transfer should be made after confirmation by e-mail by an authorized person about the availability of goods in warehouses.
The first confirmation sent automatically to your inbox is just a confirmation that the order has been placed.
Confirmation of the authorized person is sent after checking the availability of the goods.
c). The Fishing-Mart shop reserves the right to change the payment method of the order.
d). In the case of a refund to a transaction paid by a credit card, the refund is made to the card's account.
6. Shipping fees
a). The shipping fee also includes the cost of preparing the goods and packaging.
The webshop system automatically counts the shipping fee that appear in the checkout.
International shipping fees depend on the weight and length of the products.

Collection hours: Monday to Friday, 8:30-15:30.
Parcel collection procedure:
1. After the payment for the order has been booked and the order has been completed, you will be informed about the possibility of parcel collection via phone and e-mail.
2. After arriving at the following address: Partyzantów 69, Bielsko-Biała, please call 0048 33 499-26-41 and give your order number together with a 4-digit pickup code which can be found in the order.
In case you do not provide the code, you will be asked to identify yourself using any document that confirms the compliance of the person placing the order with the person collecting the order.
In case you no not provide the code, or if the person collecting the order does not match, the order will not be released.
3. A shop employee will come down with the order.
4. After signing a receipt document, the parcel will be released to you.
7. Presented products details
We’d like to inform you that the descriptions and photos of the products are created on the basis of catalogs, as well as other commercial information provided by distributors and manufacturers.
This information does in no way exclude, limit or suspend the buyer’s rights resulting from discrepancies between the goods and the contract, and Fishing Mart bears the full responsibility for the conformity of the store’s offer with the description placed on its website.
8. Order procesing time, shipment, order collection
a). The delivery is carried out via:
- delivery company GLS, UPS - delivery time depending on the country of destination,
- Post - delivery time depending on the country of destination.
The ordered goods shall be shipped to the buyer within maximum 14 working days of the day of placing an order.
To that time should be added time of transporting the order, which depends on the country of destination and type of carrier.
According to our statistics, the average procesing time is 4 days + carrier time.
Certainly, we will do our best to ensure the shortest delivery time possible.
b). Orders placed with the payment option: bank transfer are packed after posting money on the indicated bank account.
The bank account is located in: contact and webshop regulations.
c). In exceptional cases the delivery date may be extended, the customer will be informed about this situation.
The purchased goods will be delivered by a carrier at the expense of the Buyer, unless the terms and conditions of delivery referred to in the Internet Shop Websites stipulate to the contrary.
d). The Fishing-Mart shop is responsible for all damages during transport or loss of shipment.
e). Please do not accept packages damaged during transport.
After accepting a package, which on the outside didn’t bare any traces of damage, without objections, the burden of proof that the goods were damaged during transport rests on the client (in accordance with the Art. 76 item 4 of the Transport law)
f). When choosing the payment method: bank transfer, the Fishing-Mart reserves the right to change the company delivering the order from Post to a courier company, without charging the customer with additional costs.
a). Fishing-Mart webshop shall be 100% responsible for the delivery of complete product. In case a defect of the purchased product has been detected, please contact us in order to agree upon the further procedure.
Defective goods will be exchanged for full value, and if it is not available, a refund will be made to the bank account indicated by the customer.
b). The guarantee shall cover only manufacturing defects or hidden defects of the purchased product detected in the process of use as directed.
Any and all defects caused by the user (i.e. a mechanical damage, individual repair, use not as directed) shall not constitute grounds for accepting the complaint.
c). The guarantee covers only products purchased in our shop.
d). The store is liable for goods not in accordance with the contract.
10. Complaint procedure
a). Here's what to do in the case of complaints:
- Sign the warranty card with your full name
- Attach a note with the description of the damage (describe the problem with your own words).
- Send the goods at your own cost (we do not accept cash on delivery shipments) to the address:

Send the returned goods for example, by registered mail or an economic parcel.
We send goods from to the manufacturer, and after receiving the claimed equipment from the guarantor, we send it back to you on our cost and if the complaint is accepted, the customer will be returned the cheapest usual way of delivery shipped by the entrepreneur, the entrepreneur is not obliged to reimburse the consumer any additional costs incurred.
The only exception are GARMIN products, the Garmin operates a door-to-door warranty system, which means that all warranty repairs are processed outside the point of sale.

After receiving the complaint number, the entrepreneur sends such a product to the indicated address. Garmin does not repair products, only exchanges in the event of a legitimate claim.
b). We do not accept parcels complained about sent at our expense.
c). The store will respond to the buyer's requests within 14 days of receiving the request.
After checking the claimed goods and preparing the complaint protocol, it will be immediately sent to the guarantor.
In the case of a complaint regarding the amount of the ordered product or service, the User is obliged to indicate the item in question, the amount and the number of the order concerned.
The submitted complaint will be considered in the mode regulated by the Act of 27 July 2002 on special terms of consumer sales and the amendment of the Civil Code. (JoL No. 141, item 1176)

e). The ODR platform
Every Consumer may use the extrajudicial means of handling complaints and pursuing claims.

11. Withdrawal from a distance contract
a). Each customer who is a consumer within the meaning of Article 22  of the Civil Code and using the online store Fishing-Mart has the right - on the basis of the law - to withdraw from the contract concluded for the purchase of goods, without giving a reason, within the period described below.

Deadline: Consumer has the right to withdraw within a deadline of 14 days, which commences on the day the consumer receives the goods. The deadline is considered as met if the consumer sends a declaration of withdrawal to the address given above before its expiry.
Goods should be returned in the unaltered state, unless a change was necessary within the ordinary management. By ordinary management is meant such a familiarization with the goods as would be possible in a traditional store.

The form is also available as the last page of the Regulations, which is sent along with the order confirmation.
- please send back the original receipt, which is required by the Tax Office to return the previously paid VAT.
In the case of withdrawal from a distance contract, the contract is considered as not concluded. The services rendered by the parties shall be returned in an unaltered state unless the change was necessary within the limits of ordinary management. The return should take place immediately, not later than within 14 days. The entrepreneur may withhold the reimbursement of payments received from the consumer until he receives the items back.

The costs of returning goods are charged to the consumer. In compliance with Article 34 section 2 of the Act of 30 May 2014 on consumer rights.

c). The return of goods doesn’t concern transactions concluded with business entities.
d). We don’t accept packages sent at our cost.
